MARRIAGES IN MAINE
*** Effective July 25, 2002 ***
If both parties reside in Maine, but in different towns, a Notice of Intention can
be filed with the town clerk in either parties town. Formerly, Notices had to filed
in both towns.
If one member of the couple resides out of state and one in state, Notice of Intention
should be filed by both parties at the Maine resident's municipality. If both parties
reside outside of the state of Maine, they must file their Notice of Intention at
ANY municipal office.
Once filed and the license issued, the parties are free to marry anywhere within the
state of Maine. There will no longer be a waiting period between the time Intentions
are filed and the date the license is issued. Once Intentions have been filed, a license
may be issued immediately. The officiant is responsible to file the marriage certificate
with the clerk who issued the license. There will no longer be a license filed at
the place (town) of marriage.
Beginning January 1, 2002, the time period for filing a notice of appeal in most civil
cases changed to 21 days. This means that, unless a person provides a certified copy
of a waiver of their right to appeal, there is a 21 day waiting period before a person
can be remarried in the state of Maine following a MAINE divorce.
